1. Parties To This Agreement
1.1. In these Terms and Conditions 'We', 'Us', 'Our' means JB Shires Limited and 'You', 'Your' means the customer whose name and address has been inserted by You in the Order Form either on this website or in our literature.
'the Goods' means those goods which You have ordered from Us as stated by You on the Order Form either on this website or in our literature.
3. The Acceptance Of Your Order By Email, Post Or Telephone
3.1. When We receive Your Order We shall give You an order acceptance provided that your payment for the Goods has cleared.
3.2. We reserve the right to decline Your order for the Goods but We will give You a reason for doing so.
3.3. Notwithstanding Paragraph 3.1 the Goods are subject to availability from the manufacturer and may be withdrawn at any time therefore We reserve the right to cancel Your order if the Goods become unavailable or are withdrawn before delivery and You acknowledge that We shall have no liability to you except for a full refund of the price for the Goods as shown on the order acceptance.
3.4. We shall notify You in writing (which includes by e-mail) as soon as we know that the Goods are unavailable or have been withdrawn.
4. Right of cancellation and Returns
4.1. In line with the United Kingdom's Distance Selling Regulations 2000 you are provided with the right to cancel your order, for products you have purchased without viewing first hand, at any time up to the end of the seventh working day following the day after the day on which you received the products. You do not have to give any reason for cancellation. The item must not have been assembled, registered or used and must be returned to us as new, with all documents and in original packaging (no fuel having been added or stickers applied). Return costs will be at the customers expense.
When returning items we recommend you use a recorded delivery service that insures the items when returning.
We will credit the price of the cancelled product (shipping costs excluded), , but if the item has begun registration with the dvla we cannot refund the registration costs. Except if the reason for return is the product is damaged, defective, incorrect quantity or an error on our behalf.
4.2 Returns other than above can incur charges.
4.3 When returning an item please do not return without contacting us first and obtaining a returns number.
5. Price And Other Charges
5.1. The price of the Goods is the current sale price as at the date of Your order plus VAT and delivery charges.
5.2. The delivery charges will be shown on the order acceptance and their amount depends on the type of goods ordered and the delivery location.
5.3. We will give You a quotation as to delivery costs when You place Your order with Us but We reserve the right to vary the delivery charges to take into account any additional charges that are put onto Us by our delivery service providers.
5.4. Any offer for the sale of the Goods which includes 'free delivery' means free delivery within the United Kingdom mainland only.
6. Description Of The Goods
6.1. We try hard to make sure that the descriptions are accurate but the Goods may vary from those illustrated. The specifications contained in this website are for information purposes only as we cannot confirm the exact specifications of the vehicle. Maximum speeds are for guidance and are subject to weight and conditions. If you require any specific feature you must consult your Sales advisor who is regularly updated with any change in specification.
Please check model availability and full specification details with your Sales advisor prior to ordering. Neither JB Shires Ltd nor JB Shires Ltd Partners can accept contractual responsibility for your reliance on the information contained herein.
Some illustrations in this website do not necessarily reflect UK specifications and may not be available. Consequently controls and some items of equipment are positioned differently for the UK.
7. Changes In The Specification Of The Goods
7.1. Our manufacturer has reserved the right to change the specification of the Goods without prior notification to Us. If Our manufacturers does change the specification of the Goods and these changes make the Goods significantly different from those You have ordered then We shall notify You of the changes and You may then either accept these changed Goods or accept any alternative Goods that We have offered You or You can claim a full refund on the price as shown on the order acceptance thereby cancelling the agreement between Us and You acknowledge that You will have no further claim against Us arising from these changes in the specification by the manufacturer.
8. Payment For The Goods
8.1. You must pay for the Goods in full on placing Your order.
8.2. Payment for the Goods may be made by cash cheque, postal order, credit or debit card. The goods will not be released until payment has cleared.
9. Delivery Of The Goods To You
9.1. Our aim is to get your order delivered within 7 working days of cleared payment. The Goods will be delivered to You at the delivery address inserted by You on your order form.
9.2. If You decide after You have sent the order to Us that You wish to change the delivery address then please notify Us immediately in writing (which includes by e-mail) and We will inform You in writing as to whether We can accept this change in delivery address.
9.3. Notwithstanding the terms of Paragraph 9.2 if You have paid for the Goods by credit card payment then We are obligated to deliver the Goods to the card holders address and therefore we are not able to accept a change in delivery address in this case.
9.4. Subject to paragraph 9.3 if We accept Your change in delivery address We reserve the right to increase the delivery charges and this increase must be paid to Us immediately otherwise We will not accept the new delivery address and will deliver the Goods to the original delivery address.
9.5. Although We try to deliver the Goods by the delivery date shown in the order acceptance We cannot guarantee this and We shall neither be responsible to You in any way for failing to deliver the Goods on the delivery date If a delay is caused by circumstances beyond our control. We will contact you and agree an alternative date.
9.7. If You cannot take delivery of the goods on that date for any reason then We will give you another date but you may be charged a fee for this re-arranged delivery if a delivery has already been attempted or not within standard delivery hours. Which must be paid to Us before the new delivery date.
9.8. You agree that on delivery of the Goods You will provide all necessary labour to unload the Goods from the delivery vehicle.
10. Inspection Of The Goods On Delivery And Returns
10.1. Before accepting the Goods on delivery please check for any damage very carefully. We must be notified immediately of any damage.
10.2. It is your responsibility to unpack the Goods and inspect them for signs of damage or missing parts. If You see any signs of damage or missing parts delivery should be refused and We must be notified immediately that delivery has been refused and the extent of the damage or missing parts.
10.3. If You fail to inspect either the packaging or the Goods and You then subsequently find damage to the Goods or missing parts then You will be liable for the cost of repairing the damage or the supply of the missing parts.
11. Part Assembled Vehicles
11.1 Where a vehicle is supplied part assembled, final assembly for completing the vehicle requires at least some basic mechanical skill and competence. The operation and safety of the vehicle depend on the correct assembly.
11.2 After assembly it is very important to perform a Pre Ride Inspection(PRI) before using the vehicle. The PRI should be performed everytime the vehicle is to be used.
12. Pre Ride Inspections(PRI)
12.1 A PRI should be made by the user of the vehicle and should include but not limited to checking all nuts, bolts, screws, are secure, levers, wiring cable, brakes, throttle, chains, tyres etc are operating correctly.
12.2 All vehicles will require regular adjustment and maintenance. We recommend the use of recognised mechanic or dealer who has the knowledge of these vehicle.
13. Warranties
13.1 Full warranties are only applicable if a PDI(Pre Delivery Inspection) is carried out either by us or a reputable VAT registered dealer. In the case of the latter and the event of a claim, proof of the PDI will be required.
13.2 Road Legal products are supplied with a Parts only warranty against manufacturers faults unless otherwise stated in section 14. Warranties for road legal vehicles does not cover off road use.
13.3 Off Road Vehicles carry a main parts only warranty. Please check the vehicle warranty for full details .
13.4 Any parts that are deemed faulty must be returned to us for inspection/replacement. Transit costs to and from JB Shires Limited are at the customers expense. JB Shires Limited do not pay for labour for the removal and replacement of parts.
13.5 This does not affect your statutory rights.
14. What The Warranties Do Not Cover
14.1. The warranties set out in Paragraph 13 do not cover the following:
14.1.1. Damage to any item that is caused by unreasonable use, including failure to perform reasonable and necessary maintenance, or failure to follow the manufactures instructions in the owner manual.
14.1.2. routine maintenance and servicing;
14.1.3. Any part that requires replacement in connection with normal wear and tear;
14.1.4. brake linings; brake drums and brake discs;
14.1.5. clutches;
14.1.6. wheels and tyres and inner tubes;
14.1.7. batteries;
14.1.8. drive belts and chains;
14.1.9. filters;
14.1.10. plastic parts, metal trim or replacement stickers;
14.1.11. nut, bolts, screws, fasteners, cable ties;
14.1.12. bulbs, fuses;
14.1.13. lubricants;
14.1.14. exhausts;
14.1.15. seats;
14.1.16. body panels, scratches dents, cracks, tear or chips.
14.1.17. Any product used commercially, as part of a venture, resold or rented by you.
14.1.18. Defects caused by alterations or modifications, accidents, incorrect use, improper storage, incorrect fuel or lubricants, including failure to carry out Pre Ride Inspections.
15. Servicing and Maintenance
15.1 It is a condition of the warranty that your vehicle is maintained in accordance with the manufacturers recommendations by a reputable Dealer / VAT registered and suitably qualified engineer.
15.2 An original invoice and full breakdown of work will be required in the case of any warranty claim.
15.3 Failure to service the vehicle in accordance with this requirement and adhere to the breaking in instructions will void the warranty.
16. Operation And Safety Instructions
16.1. On taking delivery of the Goods You are confirming to Us that:
16.1.1. You understand the dangers and risks in operating the Goods;
16.1.2. You understand that personal safety equipment and clothing should be worn at all times when operating the Goods;
16.1.3. You understand that You and anyone who operates the Goods should first take professional instruction before operating the Goods;
16.1.4. You have read and understood the safety rules and all advice and instruction offered in the manufacturer's handbook;
16.1.5. You or another adult will at all times supervise any person who is operating the Goods who is under the age of eighteen years.
16.1.6. Where products are marked as "Road Legal" riders must have a current valid driving licence for the vehicle category, carry the correct motoring insurance and the vehicle should be registered with the DVLA. All other products should not be ridden on public roads.
16.1.7. It is advised that all owners and riders of powered vehicles have third party liability cover.
16.1.8. Vehicles are not designed for stunt riding.
16.1.9. The vehicle should be riden in as instructed by the manufacturer and should not exceed 80% of the maximum speed for the first 1500km.
16.1.10. Operating a motorised vehicle involves risk and dangers involving serious bodily harm. Purchasers assume all risks and fully assumes and accepts responsibility for events that may not be foreseeable including economic loss, social distress, losses, costs and damages caused as a result of t person's vehicle riding activities.
